Privacy Policy
At Hype Digital we respect your privacy and are committed to protecting the personal data you share with us. This policy explains what data we collect, for what purpose, the legal basis for processing, and how you can exercise your rights, in accordance with Peru's Personal Data Protection Law (Law No. 29733) and its Regulation, and international standards such as the EU GDPR.
1. Data controller
Hype Digital ("we") is the controller of your personal data.

We operate from Lima (Peru) and Orlando (USA), serving clients remotely worldwide.
2. Data we collect
• Data you provide in the contact form: name, email, company, website, budget range and the message you write.
• Browsing data collected automatically via cookies and analytics tools (e.g. Google Tag Manager / Google Analytics): IP address, device and browser type, pages visited and interactions.
3. Purpose of processing
• To respond to your inquiry and provide commercial follow-up.
• To send you the confirmation email for your message.
• To measure and improve site and campaign performance through aggregated analytics.
4. Legal basis
Processing is based on your consent — freely given, prior, express and unequivocal when you submit the form — and on our legitimate interest in answering inquiries and keeping the site secure. You may withdraw your consent at any time.
5. Data retention
We keep your data only for as long as necessary for the stated purpose and while a commercial relationship or mutual interest exists. After that it is deleted or anonymized, unless a legal obligation requires retention.
6. Processors and transfers
To deliver the service we may share data with providers acting as processors: an email provider (sending notifications) and Google (analytics and tag management). These providers may host information outside Peru; in such cases we apply appropriate safeguards for international transfers. We do not sell your personal data.
7. Your rights (ARCO) and data deletion
You have the right to Access, Rectify, Cancel (erase) and Object to the processing of your data, as well as to withdraw consent and to data portability where applicable.
To exercise them, email us at privacy@hy-pedigital.com with your request and a contact method. We will respond within the timeframes required by applicable law.
Requesting deletion of your data is free and you may do so at any time. This right applies equally to everyone, regardless of country of residence or the data protection regulation that covers them.

If you believe your request was not handled properly, you may contact Peru's National Authority for the Protection of Personal Data (ANPD).
8. Cookies and analytics
We use first- and third-party cookies for site functionality and usage measurement. You can configure your browser to block or delete cookies; note that some features may be affected.
9. Security
We apply reasonable technical and organizational measures to protect your data against unauthorized access, loss or alteration. No system is completely foolproof, but we work to maintain a level of security appropriate to the risk.
10. Changes to this policy
We may update this policy to reflect legal or service changes. The current version will be published on this page with its update date.
11. Data processed through our WhatsApp Business app
Hype Digital operates the HypeDigital_studio application (App ID 1723243592262188) on Meta's WhatsApp Business Platform, acting as a Tech Provider. We use it to send renewal reminders to our clients and, when a client authorizes it, to connect their account and measure conversions originated by their advertising campaigns.
Through that application we process: our clients' phone numbers; WhatsApp message content and metadata (text and delivery status); the identifier and access token of the connecting client's WhatsApp Business account; and, when the conversation originates from an ad, the end consumer's number and the ad click identifier (ctwa_clid).
This data is processed and stored on Google Cloud Platform (Cloud Run), southamerica-west1 region. It is shared only with Meta, as needed to send and receive messages, and with our internal management and analytics tools (HubSpot, BigQuery) where relevant to that client relationship.
You may request deletion of this data at any time and free of charge, following the procedure on the page linked below.
